Facebook ordered to pay compensation to Brazilian whose account was hacked

Facebook has been ordered by the Federal District to pay compensation to a Brazilian internet user whose Instagram account was hacked. The amount of compensation for non-pecuniary damage was set at R$ 3,000. The platform said it would appeal the decision.

Fabiano Sommerlatte, the victim’s lawyer, alleges in the lawsuit that his client’s social media account was hacked at the Rio de Janeiro airport while using the site’s public Wi-Fi network. Noticing irregular surfing, he tried to contact the company, but received no response through the service channels.

Facebook condemned

Judge Gisele Rocha Raposo of the 3rd Special Civil Court, in her decision, indicated that the social network made a mistake in security, as well as in the timing of the service, because the client tried to contact to resolve the problem and did not receive a response to his request.

“The records fully demonstrate the inability of the security services provided by the defendant to allow the account to be “hacked”, in addition to a service defect corresponding to the delay in its blocking,” the decision says.

Facebook said it would appeal the verdict, but did not provide further details.

“Documents attached to the records show that after several attempts to recover his Instagram account, the defendant remained indifferent,” reads the conclusion of the lawsuit, which led to Facebook’s conviction.
