The countdown to New Year’s Eve is on. This year, however, instead of wild celebrations with dancing and fireworks, there are again corona-related restrictions. What does this mean for my New Year’s Eve ticket?
Clubs and discos are not allowed to operate in many federal states. Even New Year’s Eve balls are banned in North Rhine-Westphalia if the main attraction of the event is dancing. Dancing is also forbidden in Berlin and Hamburg.

Many people had already bought expensive tickets to New Year’s parties, which often take place in restaurants and hotels and often include food. What is the current state of affairs? Will they stay valid or will I get a refund because I can’t dance because of Corona?
“It depends entirely on the circumstances.” “If the party organizer advertises (live) music and dance, he also bears the risk that these elements will fail,” says lawyer Arndt Kempgens (53) from Gelsenkirchen, North Rhine-Westphalia.

The organizer cancels the party and customers get their money back.
Certain elements of the event will be canceled, others (like food) will not: customers have the right to cancel and receive a full refund. Alternatively, they can join the party and receive a partial refund for the canceled components (like the dance).
Important: This also applies if the organizer promised a large fireworks show when the tickets were sold, but this is no longer allowed.
The number of guests at the party will be reduced and customers who have been “declined” will receive a refund. Customers who are still allowed to participate in a party that has been downsized by the organizer, but no longer want to, will find it difficult. You only have a right of withdrawal if the smaller party differs significantly from the advertised one.
Customers have a special right of termination if the organizer tightens the access requirements after the ticket has been sold (e.g. 3G or 2G +). Your money will be fully refunded.
Important information for customers who have booked a hotel, train tickets or flights with the party:
If no free cancellation is agreed, these costs are borne by the customer. The party organizer is only responsible for these costs when it comes to contracts; otherwise the party organizer is not.
