Evelyn Alonso files a lawsuit against her expulsion from Ciudadanos | Radio Club Tenerife

The councilor of Santa Cruz de Tenerife Evelyn Alonso, filed a lawsuit yesterday against the national leadership of her party, for violating her fundamental rights, by proposing her “definitive expulsion” without having even proceeded to formulate that expulsion, complying with the communication and hearing procedures . The councilor requests as a precautionary measure the suspension of the expulsion decreed by the national leadership, which sanctions her for a non-existent infraction, also disregarding the fundamental rights of association and judicial protection recognized in the Spanish Constitution.

The lawsuit was filed yesterday, Monday, July 6, before the Court of First Instance of Santa Cruz de Tenerife. It urges that the “definitive expulsion” of Evelyn Alonso, decreed by Ciudadanos, be declared null and void, and immediate reinstatement in the party is requested. It is also requested that the political formation be responsible for the costs of the process.

The lawsuit states that the procedure followed by the party violates the provisions of the statutes and regulations relating to the processing of the expulsion file, and also implies the violation of the rights recognized in articles 6 and 22 of the Constitution. Evelyn Alonso maintains that she acted with coherence, respecting at all times the guidelines communicated by the party, relative to avoiding government pacts or agreements to support governments with United We Can, situations that a year ago led to the expulsion of Matilde Zambudio, still pending resolution in the tribunals.

The lawsuit shows that Alonso never received – in the meetings and contacts with the party leadership – any order not to support a motion of censure against Patricia Hernández. These tests show that there has been no non-compliance on the part of the councilor, given that “she never received a specific, express and unequivocal order that prohibited her from supporting a motion of censure.”

On the other hand, the councilor does not rule out going to the administrative channel to appeal the item on the agenda, the extraordinary plenary session tomorrow and its legal consequences. Action that your lawyers are evaluating.

For Evelyn Alonso, the decision taken by the Citizens’ leadership supposes –in addition to an abuse of her political rights recognized in the Constitution- an absolute lack of respect for her person, with personal disqualifications, even slanderous, that have seriously damaged her image and good Name.
