In the case of the Viaduct, Díez Gargari stressed that the federal government has not signed an agreement, contract, agreement, permit, authorization or license in favor of the government of the State of Mexico that gives it the right to grant the construction, operation, exploitation concession. and maintenance of this highway in two sections of the Manuel Ávila Camacho Periferico, from the Toreo de Cuatro Caminos to Valle Dorado in Tlalnepantla.
Part of the Viaduct was built on these federal property, and current legislation establishes that whoever, without having obtained a concession or permit from the SCT, operates or exploits roads, bridges or terminals, will lose, for the benefit of the nation, the works executed and the established facilities.
The use, exploitation or exploitation of an asset that belongs to the nation, without having previously obtained the corresponding concession, is also configured as a crime, which is punishable by imprisonment from two to 12 years.
