DUH forces online retailers Netto to take back electronic waste


Electroretoure24 excludes old lamps

In order to regulate the return of electronic waste, Netto-Online referred to the Electroretoure24 service. This service enables consumers to print out a shipping label and send their scrap free. The problem with this is that the service excludes the acceptance of old lamps. The background is a regulation of the Deutsche Post, which does not allow the shipment of lamps. Energy-saving lamps could break during shipment and release harmful substances. For the return of energy-saving lamps, Electroretoure24 instead refers to stationary retailers, which, contrary to what is required by law, does not offer its own return option.

Thus, by referring to the service provider, Netto-Online is not fulfilling its obligations. “The court also confirms that retailers who are obliged to take back must create their own return options and inform consumers appropriately about their return rights”, summarizes lawyer Roland Demleitner, who represented the DUH in court, summarized the judgment.
