DPP Legislator Huang Jie Proposes Oath for Chinese Spouses to Renounce Citizenship and Pledge Loyalty to Taiwan

[Reporter Xie Junlin/Report from Taipei]In response to the naturalization of Chinese spouses in our country, DPP legislator Huang Jie proposed a draft amendment to the “Ordinance on Relations between People of the Taiwan Area and the Mainland Area”, adding that they must swear to renounce their Chinese citizenship and be loyal to Taiwan, and must also Other foreign spouses must pass the same examination and must possess basic Chinese language proficiency and basic knowledge of national rights and obligations. Huang Jie also emphasized that in her draft law amendment, the oath is legally binding, and violations will result in the cancellation of household registration.

Huang Jie’s proposal points out that since foreigners naturalizing Chinese nationality need to provide proof of loss of original nationality, and when Chinese people naturalize in Taiwan, it may be legally and practically difficult to ask for renunciation of Chinese nationality. Therefore, with reference to the legislative acts and nationality laws of advanced countries in the world, a draft amendment to the Cross-Strait People’s Relations Regulations was proposed, adding “obtaining the naturalization oath” and “possessing basic language proficiency in my country and basic knowledge of national rights and obligations” as necessary conditions for applying for settlement.

The draft adds that the naturalization oath must be taken publicly at a place and in a designated manner designated by the Ministry of Interior. The oath sworn is as follows: “I completely renounce my former citizenship and basic rights and obligations of the mainland area I belonged to. At the same time, I promise that after becoming a citizen of the Taiwan area, I will defend its democracy and freedom, abide by the constitution and laws, and fulfill my civic obligations.” After taking the oath, people from the mainland area signed and stamped the oath respectively and sent it to the Ministry of the Interior for record.

In addition, the proposal description points out that those who violate the “Cross-Strait People’s Relations Ordinance” hold positions or are members of party affairs, military, administrative or political agencies, institutions, groups in the mainland area that are prohibited by the Mainland Affairs Council of China. As well as the “Reverse Osmosis Law”, if the source of infiltration engages in related prohibited activities, the household registration agency will cancel the household registration in Taiwan, and shall be forced to leave the country unless there are exceptions. However, the responsibilities and obligations borne by them due to their identity as a citizen of the Taiwan Area will not be lost or exempted.
