Donald Trump has been indicted for the third time. Which allegation is the most serious and what you need to know about the trials of the ex-US President, says the lawyer and expert on US law Jürgen Rodegra in the stern-Interview.

Mr. Rodegra, you are admitted to the bar both in Berlin and in the state of New York. Would you like it Defending Donald Trump?
Why not? The function of a lawyer is that of an advocate. This applies to both German and American law. So if Donald Trump were at my door, I would listen to his problems, talk to my colleagues and if that is a reasonable mandate, then of course I would be available.

It’s up to the voter to decide how his political career will continue. I am a service provider and not a do-gooder.

In US lawsuits, as is the case now with Donald Trump, there is often talk of a “conspiracy”, i.e. a conspiracy. What do Americans mean by this?
That’s a good question because the German translation of “Conspiracy” often leads to confusion and many then think of some kind of rebellion or something similar. But the translation of “conspiracy” is “conspiracy to commit a crime”. If we both agreed to rob a bank, then this is a “conspiracy”.

What are the implications of such a “conspiracy to commit a crime”?
This offense can have serious consequences. For example, if we arrange a bank robbery meeting, but one gets cold feet. Then it could still be our turn because of “Conspiracy”, if only because we agreed to commit the crime – although we actually didn’t commit it as originally planned.

Can’t the accusation of conspiracy to commit a crime be very broadly defined?
Yes, that is a separate criminal offense. It’s not uncommon for people who think they’re uninvolved to be held accountable.

Donald Trump has now been in three states, New York, Florida and Washington, DC. charged. Another indictment in Georgia may follow. Does it matter that there are different lawsuits against him in different states?
Rather not. But you have to know: In the USA, different legal systems apply in all individual states. These can be similar, but don’t have to be. Put simply, a campaign finance lawsuit like the one in New York can look completely different in Florida. But it is difficult to predict how the respective juries will behave.

That means?
In most cases in the USA, it is not a judge who decides on guilt or innocence, but a jury. And their members can of course be influenced, for example by the media. This is difficult to avoid. As such, the course of other parallel lawsuits may have an indirect effect on the jury.

Who sits on such juries?
To put it bluntly, the members are collected on the street. They are randomly selected people: bus drivers, a doctor, teachers, in any case mostly legal laymen.

Does that mean the judges are not so decisive? In Washington, Tanya Chutkan, a chairwoman who is not considered a Trump supporter, is leading the case, unlike the judge in Florida, Aileen Cannon…
However, the role of judges should not be underestimated. You direct the procedure and this also includes informing the jury about the legal background and giving them tips. Because it often gets complicated: Everyone knows what a theft is. But what exactly does election rigging or misappropriation of campaign funds mean? The jury needs to know that in order to be able to make decisions. That alone makes judges very important.

Which of the three charges so far do you think is the most serious?
That is hard to say. Basically, these are all crimes that ordinary people cannot commit. Who is in a position to embezzle campaign donations? That’s why there are no precedents to look up to. How this will turn out in the end is like looking into a crystal ball.

Donald Trump said if he got the maximum sentence everywhere, it would be more than 500 years in prison. Is he right?
Might be. But these are such unique occurrences that nobody has any experience with them. It is also questionable whether there will be one or more convictions at all. It is also possible that somehow they will try to resolve matters through deals. All of this is very difficult to predict. But I’m sure that a lot can be expected and that the shreds will still fly.
