Do you file taxes with ITIN in NY? Don’t Forget This Form If You Got Financial Aid – NBC New York (47)

New York taxpayers who received unemployment compensation through the state’s Excluded Workers Fund should have received a Form 1099-G from the Department of Labor.

The document details in Box 6 the total amount received by the worker and in Box 11 the New York taxes withheld.

The state requires that recipients of the Excluded Workers Fund file the form when filing their taxes, because although state taxes have already been deducted, the payments may be subject to federal taxes.

You or your tax preparer will need to be sure to enter the New York Department of Labor EIN, the amount of the taxable grant, and the amount of state tax withheld.

The form was sent to the address on the Excluded Workers Fund application. If the payee’s address changed and you asked the USPS to resend your mail from your old address, check this page. Change of address information will be updated as it becomes available.

WHAT IS FORM 1099-G?

It’s a tax form that shows how much you were paid in benefits from the New York Department of Labor (NYSDOL) in a specific calendar year.

WHAT SHOULD I DO WITH TAX FORM 1099-G?

You must include the form with your tax return and include the benefits paid to you in your earnings for the applicable calendar year.

If you hire a tax preparer or file electronically, be sure to include the 1099-G with your other tax information for the calendar year.

You can choose one of the two methods below to obtain your 1099-G tax form:

ONLINE

Form 1099-G for calendar year 2021 will be available in your online account at labor.ny.gov/signin to download and print. You just have to follow the instructions.

TELEPHONE

If you do not have an online account with NYSDOL, you can call 1-888-209-8124.

This is an automated phone line that allows you to request your 1099-G through Postal Mail. The form will be mailed to the address on file with the state.

THE ADDRESS ON MY 1099-G TAX FORM IS INCORRECT. WILL THAT AFFECT MY REFUND?

No, as long as the ITIN on the form is correct.

WHAT IS NEW YORK STATE DEPARTMENT OF TAXATION AND FINANCE NOTICE DTF-960-E AND WHAT SHOULD I DO?

It is a notice that you owe taxes on your benefits. If you agree with the information included in the determination, you may pay the proposed amount due in any of the following ways. You must also complete and return the consent section on page 4 of the notice.

  • Online at www.tax.ny.gov
  • Call the Tax Department at (518) 457-5434 and using the PIN indicated on your letter
  • Mail the payment check included in your letter to NYS Assessment Receivables, PO Box 4127, Binghamton, NY 13902-4127

If you disagree with the information included in the determination, you may informally contest the notice by following the instructions on page 2 of the notice. If you informally protest the amount, you are not required to pay the proposed amount due. However, interest and penalties will continue to accrue. You can protest the proposed amount due:

  • Online at www.tax.ny.gov
  • Call the New York State Department of Taxation and Finance at (518) 485-5909.
  • Or mail or fax the protest (following the instructions in the letter) to NYS Assessment Receivables, PO Box 4128, Binghamton, NY 13902-4128, or Fax: (518) 435-8521.

The tax department will review the information and, if appropriate, modify the proposed amount due.
