David Moszkowicz (71) died of lymphoma | Inland

David Moszkowicz worked for many years as a criminal lawyer and together with his brother Max junior, who handled civil and administrative law cases, ran a partnership with offices in Maastricht and Amsterdam. In particular, he handled many cassation cases at the Supreme Court. After his youngest brother Bram was no longer allowed to do his job as a lawyer, David Moszkowicz was confronted with many of his criminal cases.

In 2017 he was – as it is called – removed from the tableau, following his younger brothers Bram and Robert. The disciplinary court, the highest disciplinary judge, ruled that he had “a pattern of unprofessional conduct.”

Suspension

David Moszkowicz has been given seven suspended or unconditional suspensions since 2007. The accusation was that he did not record agreements between himself and his clients, and that he did not delve into a file.

The straw that broke the camel’s back for the disciplinary judge was the fact that David Moszkowicz assisted a Somali family for 1,700 euros, a member of whom had been murdered in Zwolle. He did not tell the Somalis that he was also assisting the suspect in the case.

The ex-lawyer has always said that he only discovered shortly before the hearing that he could not assist the next of kin, but the Public Prosecution Service appeared to have pointed out the conflict of interest to him months earlier.

“He is unworthy to practice the profession of lawyer any longer,” the highest disciplinary judge ruled.
