Cowell Bankrupt, Consumers Must Do This To Avoid Losing

Jakarta, CNBC Indonesia – PT Cowell Development Tbk (COWL) has been declared bankrupt, which raises a big question mark for consumers who buy property from the developer of this public company.

PT Cowell Development Tbk’s Consumer Law Attorney, as well as Business Law Teacher at the Sharia Faculty and UIN Jakarta Law, Mustolih Siradj, said that there are several things that must be done by consumers.

“First, consumers must collect evidence in the form of transactions that have been carried out. For example, they have already paid in installments on houses, and so on,” he told CNBC Indonesia in Jakarta, Sunday (7/19/2020).


The second step is after collecting the evidence and then registering it. Third, consumers can come to the creditor hearing, this is especially when matching data must come, because what the curator sees is the evidence.

“Only then will consumers be sure whether to enter the list,” he said.

Another step is to oversee this process together. Because in this case there will certainly be a lot of interest, which will involve three types of creditors. First preference like tax interests. Second, separatist creditors, usually banks that hold collateral rights.

“The third is concurrent creditors, namely consumers. The lowest creditor, who does not have anything. But still, has the right to be paid,” he said again.

Previously, the Panel of Judges at the Commercial Court of the Central Jakarta District Court ruled that the property developer, PT Cowell Development Tbk. (COWL) is in bankrupt status. The court’s decision was widely discussed in cyberspace, the article many consumers who questioned the fate of the property that was purchased but has not yet been handed over.

The bankruptcy decision is stated in the letter Item No.: 21 / Pdt. Sus / Pailit / 2020 / PN.Niaga.Jkt.Pst.

Cowell applied for two things, namely the application for a bankruptcy statement with the applicant of PT Multi Cakra Kencana Abadi, as a creditor. Multi Chakra filed for bankruptcy on June 17, 2020.

Not only that, PT Mega Sukses Bersama also submitted a postponement of debt payment obligations (PKPU) on June 17, 2020, with case number 154 / Pdt.Sus-PKPU / 2020 / PN Niaga Jkt Pst.
