Court Rules in Favor of Singer Young Tak in Trademark Dispute with Yecheon Brewery

Singer Young Tak, who is in a trademark dispute with the manufacturer of the makgeolli brand ‘Young Tak Makgeolli’, won the first trial.

The Seoul Central District Court ruled that Young Tak won part of the lawsuit against the manufacturer Yecheon Brewery asking for a ban on the use of product marks.

Then, makgeolli products marked with ‘Young Tak’ must not be produced, transferred, rented, imported, or marked on makgeolli products, and ordered to be erased from products that have already been manufactured.

The court judged that Yecheon Brewery’s use of ‘Young Tak’ in its advertisements could cause misunderstanding among consumers that it had a close relationship with singer Young Tak.

However, the court did not accept Young Tak’s request to destroy products owned by third parties.

Yecheon Brewery previously signed a one-year contract with Youngtak in 2020 and released ‘Youngtak Makgeolli’, but the negotiations to renew the advertising model broke down and conflicts arose.

Yeong-tak filed a civil lawsuit in 2021, claiming that Yecheon Brewery was using ‘Young-tak’ even though the contract was over.

Yecheon Brewery appealed against the first trial ruling.
