State Social Court President Wolfgang Siewert, however, only has outsider opportunities. Tully’s choice is still considered certain.

Hamburg. Actually it was Replacement of the highest Judge’s post in Hamburg already a foregone conclusion: the broad approval in the judges’ selection committee for Marc Tully, the president of the regional court, as the new president of the higher regional court was considered certain. Justice Senator Anna Gallina (Greens) has spoken out in favor of Tully. But shortly before the committee’s decision on November 18, there is now a counter-proposal.

Beat three members of the 14-person judges’ selection committee Wolfgang Siewert, President of the Regional Social Court, as the successor to Erika Andreß, who retired at the end of October. Spicy: One of the Siewert supporters is Gallina’s party friend and lawyer Ernst Medecke. The proposal is supported by lawyer Arne Timmermann and judge Frank Frind, both of whom were elected to the committee as civil members at the suggestion of the left.

The choice of Tully is still considered safe

Tully is credited with having had an integrating effect in the two years as president of the district court and that he is well connected. On the other hand, he is considered a more conservative criminal judge. This assessment may have played a role in the counter-proposal.

According to observers, Tully’s election is still considered safe. According to this, both the judicial members (the “bench of the judges”) and the members of the committee sent by the SPD should continue to speak out in favor of Tully. In addition, Medecke and Timmermann are deputy members of the judges’ selection committee who have the right to propose but are not allowed to take part in the vote.

The judges’ selection committee is not least characterized by its independence, which leads to some surprises. Gallina also had to experience this in her short term of office: Her proposal for the post of director of the Blankenese district court, Götz Göttsche, fell through in the middle of August in the judges’ selection committee. After a stalemate in the first ballot, the committee voted in the second vote for Vice Director Anja Fanselow, who had only been proposed by the Green Party during the meeting.
