Controversy Surrounding Sale of Grove in Varna Sparks Legal Battle and Protests

The Municipality of Varna is selling for the purpose of development a grove, cared for and planted by the citizens. They are doing everything in their power to save her – after protests failed, their lawsuits are now snowballing. Such a “neighborhood” plot takes place in the seaside town at the end of the term of office of the local authority.

The case concerns about 9 acres in the “Mladost” area, on the border of the “Troschevo” district, next to the Delta Planet Mall. The municipal council voted to sell them, and a building will appear on the field, part of which the builder will hand over as an office to the administration of “Mladost” – now scattered in separate blocks. On one side of the conflict is the desire of the people to protect the greenery, and on the other – the fact used by the municipality that the area has a building permit with a density of 60%, a cornice height of 26 m, etc. Beyond the dry facts, however, a few points are interesting:

Although Varna’s PMU does not foresee a grove, it has been there for decades. Remaining from “once upon a time”, people use it, value it, plant it… Now hundreds of trees will have to be cut down, which in the middle of the general development are literally like the lungs of the city. And we come to the first important point: documents, laws, should not be dead matter, blind – they should serve people, not the other way around. That is, if there is a management desire, there is no problem for the grove to remain, regardless of the OUP, PUP, etc. And, of course, the plans can change – again it depends on the managerial desire. But it is the opposite that is the cause of trouble – not plans and laws.

Second, when will it finally be understood that the cementing of the earth by construction, destroying grass, soil or other natural layer, is a factor in urban flooding? Isn’t there supposed to be an unstoppable prevention? The water simply has nowhere to soak.

Thirdly, no administrative building, although Mladost region needs it, cannot be a priority over the above considerations.

Fourth, although the opposition local parties objected to what was planned, and the case is taking place in a pre-election environment, the important thing is that the citizens are currently struggling to save their grove more alone than with political patronage. In the complaints to the Varna administrative court, which in a few days grew from 16 to 22, they simply wrote that it was about vegetation, greenery; they walk there, they breathe, they rest, they don’t build buildings – that’s how humans reasoned – which can play a bad joke on them, because Themis is excited by dry legal matter instead of living life.

The complaints are expected to be consolidated into one case. The court clarified to “Sega” that there is also a need for clarification – that complaints should be submitted through the relevant body (the municipal council, whose decisions people are attacking), and that citizens should prove a legal interest (which, according to experience, is difficult).

But the battle is clearly ahead. The regional governor Andriana Andreeva is also on the move, in whose powers it is to return the decisions.
