Consumer Advice Center Forces Insurance Company to Remove High Fees from Riester Contract

A clause in a Riester contract contained high fees for a consumer. The insurance company may no longer use this after a warning from the consumer advice center.

In 2004, Ms L. concluded a Riester contract with what was then BHW Lebensversicherungs AG (today LPV Lebensversicherung AG). When Ms. L. applied for the complete withdrawal of the capital for housing use (Wohn-Riester), this was also approved by the allowances office.

But what made Ms. L. suspicious: For the payment, the LPV insurance company demanded “costs of up to 10 percent of the total amount withdrawn” with reference to their general insurance conditions. For a withdrawal of around 38,000 euros, fees of 3800 euros would be due. After Ms. L. contacted the consumer advice center, her doubts were confirmed. After the legal examination of the clause, the consumer advice center warned the insurer and asked him to no longer use the clause or to refer to it.

This practice unreasonably disadvantages consumers for various reasons. LPV Lebensversicherung then issued a cease-and-desist declaration. The company can no longer refer to the clause and cannot bill Ms. L. for up to 3,800 euros. Ms. L. can now withdraw the credit from the Riester contract free of charge.
