Company Named MetaX Sues Facebook Parent Company For Name Stealing – IT Pro – News

A company with the brand name MetaX is suing the Facebook parent company of the same name for stealing the company name in question. According to the prosecutor, the company is disadvantaged by the possible confusion of identity.

The plaintiff, MetaX LLC, was court documents founded in 2010 and has been using the brand name Meta ever since. When Facebook in October 2021 was renamed to Metathe Facebook parent company allegedly infringed the “intellectual property of MetaX and its federally registered trademarks and trademark rights.”

In its own words, the possibility of operating the art installation company MetaX has been made impossible since Facebook has implemented the name change. “Consumers probably mistakenly believe that our goods and services are made by Facebook, which is why we are associated with the toxicity inherent in Facebook.” In the lawsuit, MetaX is demanding that the Facebook parent company stop using the Meta brand name for products and services that overlap with MetaX’s business. The company also wants compensation. The amount is unknown.

In a blog post on the website of MetaX informs the company that it has been trying to negotiate with Facebook’s parent company for the past eight months. This would have yielded nothing, which motivates the lawsuit in question. Court documents show that correspondence between the tech giant and the art company has indeed taken place. The two sides are said to have crossed paths in 2017, well before Facebook’s name change. The tech giant should therefore be aware of the existence of MetaX. A Facebook employee later alleged that the two companies offer “drasically different goods and services.”

The relatively small MetaX does indeed seem to have the rights to the trade name, but lawsuits in this category are usually complex. When two companies indeed serve drastically different markets, the same name can be used. MetaX states that its work overlaps with that of its Facebook parent company, given its focus on VR, AR and the metaverse. Facebook has not yet responded to the lawsuit.
