The investigation against the Prosecutor General was terminated on the grounds that there were no pending files against Sevdelina Arnaudova. However, 3 weeks later, her income test was terminated.

The prosecutor’s office gave another illustrative example of how inspections are conducted when there are suspicions of abuse by the chief prosecutor and why he is untouchable according to the court in Strasbourg, the Venice Commission and the authoritative lawyers in Bulgaria.

The specialized criminal prosecutor’s office has closed the case on the signal of the civil association BOEC for the detected unofficial communication between Ivan Geshev and Sevdelina Arnaudova, PR of the leader of GERB Boyko Borisov, announced Sega newspaper, citing the decree of prosecutor Ventsislav Ferdinandov. It is published on the BOEC website 8 days ago.

The investigation against Geshev is terminated on 27 September on the grounds that there were no pending files against Arnaudova, for which he would eventually intercede. At the moment, however, there is a pending file against her.

Geshev chatted with Aranudova “from upbringing”

reads his explanation, and the examining prosecutor considers it a “pure coin” and refuses to investigate further.

The head of the state prosecution was filmed writing to Arnaudova and sending her smiles during a meeting of the legal committee in parliament on September 10th, when the closure of special justice was discussed. BOEC contacted the Supreme Judicial Council, the Supreme Cassation Prosecutor’s Office and the Ministry of Justice, arguing that “this is a serious conflict of interest and Geshev owes an explanation for his relationship with Arnaudova and the prosecution’s actions on the signal against her.” The signal against Arnaudova dates back to last year and concerns the origin of the funds used to acquire an expensive property in Bistrita and an apartment in Sofia, which she owns with her husband. This case against her was terminated on October 19.

The speedy inspection of the Attorney General

On September 27, Prosecutor Ferdinandov concluded that there were no pending files or cases against Arnaudova and that she had not been convicted, so it was absurd to allege in the signal that Geshev had abused his power to influence prosecutors in her favor. He ruled that there was no crime committed by the Prosecutor General or any damage caused.

“Only 13 days after the initiation of the inspection on our signal, the prosecutor’s office refuses to investigate. For a total of 6 working days it has initiated an inspection, collected all information, made an in-depth analysis and concluded that no crimes were committed.” commented by BOEC.

In the prosecutor’s office, the events seem to have gone fast – on October 25, prosecutor Ferdinandov was already appointed deputy head of the Pleven District Prosecutor’s Office.

The late termination of the investigation against Arnaudova

However, it turns out that there is a pending file against Arnaudova until October 19. On that date, Prosecutor Albena Racheva of the Sofia City Prosecutor’s Office refused to open an investigation into the allegations that Arnaudova and her husband and Delyan Dimitrov acquired an expensive property in Bistritsa and an apartment in Sofia, it became clear again from the website of BOEC, which also published this decree.

The inspection in question is again on a signal from BOEC – since June 8, 2020 for illegal enrichment, corruption and evasion of income.

This means that when the prosecutor Ferdinandov established that there were no pending files against Arnaudova, in fact there were. This shakes his argument that BOEC’s signal against Geshev is unfounded.

Dnevnik looked for the prosecutor at his new job. Through the mediation of the spokesman of the Pleven prosecutor’s office, we received an answer that Ferdinandov was no longer competent in the case and did not have his decree, so he could neither provide it nor comment on it.

What is being investigated in both cases

It is clear from the chat decree that only Geshev was heard in the case, but not Arnaudova. According to prosecutor Ferdinandov, during the meeting of the legal commission, Geshev was searched on his mobile phone several times by various prosecution officials through a communication application installed on his mobile phone. Among other calls, Geshev received text messages from Arnaudova, recorded on his phone as Pi ar Sevi.

“With the first message Arnaudova indicated the name of the currently speaking GERB MP – A. Nikolov. Given the ongoing debate, although it was not convenient to communicate, from upbringing, Mr. Ivan Geshev responded succinctly to the message with the so-called symbol. “emoticon,” the decree reads.

For Arnaudova, Geshev explained that he knew that she had been dealing with public communication at the Council of Ministers until April 16 this year, knew her only ex officio and pointed out that his office phone was publicly known and he could not control those who called or wrote to him. . Prosecutor Ferdinandov apparently did not doubt the words of his superior and did not investigate the contradiction between the alleged official relations and the family recording of the contact on Geshev’s phone.

“For this reason, the person was recorded in his phone book in such a way as to tell him who she was and what she was doing,” the prosecutor wrote. He notes that his boss Geshev responded succinctly to the publicist with an emoticon. It is not clear whether the verifier requested access to the entire chat and whether it was provided to him.

On the other hand, the prosecutor pointed out that Arnaudova had a clean criminal record and that there were no pending files against her, and without summoning her for questioning, he concluded that the allegation in the BOEC signal against Geshev was absurd.

The decree also contains an extensive analysis of the functions of the chief prosecutor and an explanation that the prosecutor’s office is unified but not centralized, and prosecutors and investigators are no longer subordinate to the chief, a statement Ivan Geshev has repeated in his defense since his appointment. top of the prosecution.

Prosecutor Ferdidandov points out that there are legal guarantees for non-interference in the internal conviction of prosecutors, because “The Prosecutor General may revoke their acts, but only in writing and with reasons, if the act in question has not been subject to judicial review “.

On checking for the property of Arnaudova, explanations were taken from her and it was concluded that there was no crime. She said that the purchase was with loans and donations from her mother. It was reported that the family’s income is high and there is no doubt about their origin.

Finally, a question about Vasil Bozhkov

Arnaudova was asked about her acquaintance with Vasil Bozhkov. In June last year, he announced that he had visited her every month and called on then-Prime Minister Boyko Borissov to answer why. This caused Arnaudova to write to him openly a letter declaring itself Scheherazade and repulsed the attacks that she went to receive money for her boss, explaining that the matter was intimate.

For the second year in a row, Bozhkov’s signal that he gave is maturing in the prosecutor’s office bribe of over BGN 60 million to Borissov and his Minister of Finance Vladislav Goranoin, but so far it was not known that investigative actions had been carried out on him. Arnaudova’s interrogation is the only thing that becomes known in this case. She explained that she had known Bozhkov since 2011, when his PR man met them. He had not offered her money, influence, or other benefits. She has met with him 3-4 times, the last time in 2013, and since she worked in the Council of Ministers she has not seen or heard him. She had not mediated him for anything related to the government. Arnaudova said Bozhkov did not offer or bribe Borisov, Vladislav Goranov or other cabinet members.

In Scheherazade’s letter last year, Arnaudova said: “And yes, when I saw you, Mr. Bozhkov, I was aware that you had a camera and a microphone, and I did not. And I did not ask You, you offered! It is not masculine to save this part of the truth, it is true that it was a long time ago more than 6-7 years ago. I am sorry that you remember selectively! However, I remember well not only our first meetings, but also the last – at the headquarters of GERB I met you with Mr. Florian Skala – CEO of bTV! “

The prosecution has never tried to clarify what these meetings of Arnaudova with Bozhkov, who is one of the most persecuted defendants in its history – with nearly 20 charges, all for serious crimesbut nevertheless refused to be extradited from Dubai.

There is a criminal after all – the photographer

Prosecutor Ferdinandov still found a crime – on the people who filmed and disseminated the Attorney General’s chat. According to him, they had trampled on the secrecy of his correspondence. However, the Special Prosecutor’s Office did not have the competence to check this text by the Penal Code. According to BOEC data, the Sofia District Prosecutor’s Office has taken care of this.

A few days ago, comments began on the profile of lawyer Nikolay Hadjigenov on Facebook, in which he and other people stated that they had taken pictures.

BOEC stated that they would appeal the two decrees.
