Chanel accuses Huawei of copying its logo

Chanel accuses Huawei of plagiarizing its logo for several years. A court decision ultimately rejected the complaint formulated by the luxury brand. According to the judges, the logos of the two brands are not similar.

In 2017, Huawei registered the logo of a computer hardware brand with the European Union Intellectual Property Office. This trade name consists of two vertical semicircles nested one within the other. A thin circle is visible around the composition.

Chanel, a French brand of haute-couture and luxury products, quickly stepped up to the plate to ban the registration of this logo. Chanel’s complaint is dismissed

In 2019, Chanel’s complaint was dismissed. The European Union Intellectual Property Office considered that there was no similarity and no likelihood of confusion in the public mind between the two acronyms. Tenacious, the luxury brand turned to the General Court of the European Union. Two years later, the court ruled in favor of Huawei. Chanel’s appeal was rejected on Wednesday April 21, 2021, report our colleagues from Reuters. Here again, the authorities considered that the similarities between the two logos were not sufficients.

“The figurative marks in question are not similar. In particular, Chanel brands have more rounded curves, thicker lines and horizontal orientation, while Huawei brand orientation is vertical. Therefore, the Tribunal finds that the marks are different ” decides the General Court of the European Union, stressing that the “Logos should be compared as requested and recorded, without changing the orientation of the elements”.

To assert his point of view, Chanel is free to appeal to the European Court of Justice. For now, the French brand has not yet commented on the court decision, Reuters said.
