Carlos Pineda’s candidacy remains suspended, CC still has not resolved and requests a file

The Constitutional Court (CC), asked the Department of Political Organizations of the Supreme Electoral Tribunal (TSE), the file of the opinion in which it concluded that the assemblies of the Prosperidad Ciudadana party would have irregularities, this through an order to better fail.

The CC was scheduled to hear the appeals filed by Carlos Pineda and other candidates, but it was moved to another date. Upon receiving the requested file, they must read it, analyze it and see the legal foundations of the Department of Political Organizations. Then decide if you are correct.

The Sixth Chamber of the Contentious Administrative Court granted a provisional amparo filed by the Cambio party of Manuel Baldizón and his children. With this, they challenged an ordinary national assembly of Citizen Prosperity, held on November 20, 2022.

Cambio reported that they detected a series of apparent irregularities in the National Assembly of Citizen Prosperity and these were included in the amparo they presented.

This resolution resulted in the TSE’s Registry of Citizens issuing resolution SRC-R-1830-2023 on May 21, suspending the candidacy of Carlos Pineda and the candidates of Prosperidad Ciudadana at the national level.

The opinion of the Department of Political Organizations details that the delivery of the financial report, list of signatures of the delegates present at the assembly, was not fulfilled and the process of representation of minorities, which determines the norm, was not carried out.

Issue that the Ciudadanos registrar indicated that this was not the case, and that the Prosperidad Ciudadana party complied with what the report indicates. It is from this account that the November 2020 assembly was endorsed.
