Car technical inspection. Mandatory photos of the car is the MI project

Introducing the obligation to document the photographic presence of the vehicle during technical examinations. This is one of the changes envisaged by the amendment to the Road Traffic Law that is being prepared by the government. The new regulations are to enter into force from the beginning of next year.

The draft prepared by the Ministry of Infrastructure was published on the website of the Government Legislation Center. Amendments to the Road Traffic Law have been prepared in connection with the EU Directive 2014/45 / EU.

“Taking into account the fact that the system of technical tests in Poland requires reconstruction, the introduction of the above solutions is necessary in order to increase the level of road safety and, consequently, to properly achieve the goals in the scope of the implementation minimum set by the EU regulations” – he explained resort.

“Directive 2014/45 / EU should be implemented into Polish law by May 20, 2017, and should apply from May 20, 2018” – it was written in the justification to the draft.

Changes in technical research

The amendment introduces the obligation to document the presence of a vehicle by photography during technical examinations. The photos are to be kept for five years from the date of the survey.

“This solution will allow for the identification and verification of whether a given vehicle has actually been subjected to a technical inspection. Photographic documentation of the entire body of the vehicle from two diagonals at the front and rear was deemed necessary, as well as an indication of the odometer on the day of the technical inspection” – reads the justification.

“The designated period of five years is equivalent to the minimum period of keeping non-archival records” – added.

Moreover, the draft proposes “the introduction of instruments of influence by the body supervising vehicle inspection stations and the body supervising the correctness of carrying out technical inspections of vehicles”. This includes, for example, ad hoc inspections of entrepreneurs and other entities operating vehicle inspection stations, introducing the institution of repeated technical examination in the event of irregularities or doubts.

The bill is to leave to the starosts supervision of vehicle inspection stations, including keeping registers of entrepreneurs running vehicle inspection stations. The Transport Technical Inspection Director is to supervise the system of ensuring the proper quality of technical tests of vehicles.

“The staroste will be able to direct the vehicle for an additional technical examination after receiving the application of the TDT Director in the case of a justified supposition that a technical examination has been carried out, the identification mark has been placed and other activities of a diagnostician related to the vehicle’s admission to traffic have been performed, contrary to the regulations” – we read.

The director of the Motor Transport Institute is also to be responsible for examining candidates for diagnosticians and diagnosticians.

The amendment provides for “the creation of a central register of diagnosticians ensuring proper supervision and the ability to quickly react to revealed irregularities”. In addition, the creation of a new training system for candidates for diagnosticians, as well as professional development workshops.

The amendment is to enter into force from the beginning of 2021.
