Borissov’s speech led to a sharp position of the capital’s lawyers – Bulgaria

The General Assembly of the Sofia Bar Association (SAC) came out with a sharp position due to the resignation of the resigned Prime Minister Boyko Borissov and a voted proposal of the MRF in the Parliament. Representatives of the organization gathered today, and during the event an open letter was read, prepared by the Sofia Bar Council and approved as a position of the whole college, reports lex.bg.

The first complaint of the lawyers is about the inclusion in the Rules of Procedure of the National Assembly of a provision according to which its legal commission will hear every three months the chairmen of the Supreme Courts and the Prosecutor General. The initial proposal was for a periodic hearing of only the Prosecutor General, but at the insistence of the MRF and with the support of GERB and BSP, it was agreed that the legal commission would call the presidents of the two supreme courts.

The comment of the resigned Prime Minister Boyko Borissov that “the mutri’s lawyers will crush the chief prosecutor and the chief judge in parliament“also provoked an angry reaction among lawyers. Borissov’s words were obviously addressed to the deputies from” Stand up! Nikolay Hadjigenov and Tatiana Doncheva, who are lawyers for affected parties in some of the landmark cases in recent years. However, they voted against the MRF’s request, while it was supported by GERB deputies.

The open letter of the lawyers was read by the Deputy Chairman of the Sofia Bar Council Zhana Kisova, and then supported by all present at the General Assembly. She pointed out that the two events that gave rise to it call into question the rule of law and the legal profession cannot be indifferent and must take a stand and speak loud and clear.

The open letter states that while the hearing of the Prosecutor General is supported by the Constitution, that of the presidents of the Supreme Court of Cassation (SCC) and the Supreme Administrative Court (SAC) violates it. Lawyers point out that it is inadmissible to exercise parliamentary control over representatives of the court.

“We also strongly oppose the creation of a public attitude to bind lawyers with criminal interests,” the college said in response to the resigned prime minister’s words, pointing out that the suggestion that lawyers were targeting the crushed representatives of the court and prosecutor’s office was a direct attack on the whole legal profession “, the position reads.

A letter with the same complaints was spread to the media by the Blagoevgrad Bar Association.
