The higher administrative court ruled that a hostel owner in Berlin-Charlottenburg had to paint his colorful facade gray or beige. An American entrepreneur has the rights to the work – and he wants to sue.

The colorful facade of the “Happy Go Lucky” hostel on Stuttgarter Platz in Berlin-Charlottenburg needs to be painted over. This was decided by the Higher Administrative Court (OVG) in Berlin-Brandenburg after a year-long legal dispute and thus upheld the lawsuit brought by the Charlottenburg-Wilmersdorf Public Order Office.

The reason given was that the colorful facade, which can also be seen from the S-Bahn line, does not fit into the environment. The owner has to declare by Monday whether he is going to paint the house beige or gray, as required by the OVG.

The responsible district councilor Christoph Brzezinski (CDU) told the rbb that the discretion was very small. The facade design violates monument protection and the ban on defacing under building law. Therefore, the rule of law has no other option than to enforce the judgment.

Image owner wants to sue in US courts

However, the owner of the house points out that the picture, which was designed by artist Dom Browne in 2016, now belongs to an American marketing company who wants to sue for its removal – including in US courts.

In 2016, the Irish artist Dom Brown decorated the facade of the hotel on Stuttgarter Platz with smileys, hearts and a stylized lettering with the name of the hostel.
