Bakkerij Andere Koek in Raadhuisstraat has to close the catering section

Bakkerij Andere Koek in Raadhuisstraat is not allowed to operate a catering area, the court ruled. The shop focuses too much on tourists with the seating area, which is contrary to the zoning plan.

Customers can eat their sandwich at tables and chairs in the bakery. According to the municipality, there is a so-called mixing formula (retail trade and catering). Sandwiches are also prepared that are intended for direct consumption. This is not allowed because of the current ban on tourist shops in the city center.

The owner filed a lawsuit to keep the catering section open, arguing that the store would otherwise be unprofitable. The municipality had sent an email in 2018 stating that a mixing formula was allowed, but came back to this in a later email. At the time, a person was referred to a more knowledgeable official, but was never approached.

According to the judge, the owner could have known that a mixing formula is not allowed at that location and thus the municipality is in favor. The case was previously discredited when it opened near the Anne Frank house in 2018 under the name Anne & Frank. After the fuss the name was changed to Andere Koek.
