Artists submit urgent applications against theater closings

Munich / Berlin (MH) – The initiative “Stand up for art” has submitted an urgent application to the Bavarian Administrative Court against the pandemic-related closure of cultural institutions. The application was made on behalf of Wolfgang Ablinger-Sperrhacke, Kevin Connors, Marlis Petersen, Hansjörg Albrecht and others, the initiative announced on Monday. The artists are against the 12th Bavarian Infection Protection Measures Ordinance (BayIfSMV), which regulates a blanket ban on concerts and performances.

The ordinance violates the freedom of art guaranteed unconditionally in Article 5 of the Basic Law and also does not meet the special obligation to justify artistic freedom stipulated by the Infection Protection Act in November 2020. The amendment to the BayIfSMV last Thursday “continues the systematic placement of the performing arts behind them and even expands them,” explained the initiative. While theaters and concert halls could only open if the incidence remained stable or even declined and only from April 12, restrictions in other areas such as retail would be lifted even if the incidence was higher.

A good ten days ago, the artists had already filed a popular complaint with the Bavarian Constitutional Court. Numerous prominent supporters have now joined the “Stand up for art” initiative, including many artists such as Lisa Batiashvili, Sasha Waltz, Rolando Villazón, Kent Nagano, Thomas Hengelbrock and Herbert Blomstedt, as well as choirs, organizers, artist agencies, associations, publishers and cultural politicians.
