“Appeal for Ferdy Sambo and Co. in Pre-Meditated Murder Case Likely to Stand, Criminal Expert Says”

Freddy Sambo, Putri Candrawathi, to Strong Ma’ruf, the accused in the premeditated murder case against Brigadier N Yosua Hutabarat, officially filed an appeal against the sentence he received. Even so, it is considered that the sentence of Ferdy Sambo et al will not change.

Hibnu Nugroho, criminal law expert from Jenderal Soedirman University (Unsoed) revealed this. He said basically there are several possibilities that occur in a decision at the cassation level.

“Talking about the possibility (of changing the sentence) everything can happen because the name of the cassation examination is a legal examination. So here will be a battle of legal opinions. So if you talk about possible possibilities because the interpretation of the law is different. Yesterday it was PT between the courts, but this is a judex juris regarding the application of the law. Is the application of the law correct, were there any mistakes, were there any mistakes. That is what is being assessed,” said Hibnu to journalists, Monday (22/5/2023).

“For example, yesterday the theory about the statement was debated, that will be tested at the cassation level. So if you talk about the potential it can change, yes it can change, but if later the law agrees with the district court later it can be the same. Therefore the decision can later strengthen the district court or consider alone but the punishment is the same or can be canceled by trying it yourself, but it’s a bit heavy,” he said.

Returning to the cassation filed by Ferdy Sambo et al, Hibnu assesses that the opinion of the Supreme Court justices will not differ from that of the court. According to him, the theory used is good.

“I think the Supreme Court justices will not be much different because the concept of proof that was carried out yesterday was completely okay. Then regarding theory, I think everything is okay,” he said.

He hopes that Ferdy Sambo et al’s sentence will not change even though there are different considerations. This is because this case is a national case that puts the dignity of the judiciary at stake.

“So hopefully in this process as a form of bringing the dignity of the institution which is a national case, it will stick to the existing punishments even though the legal opinions are different, the considerations are different but the punishment remains the same,” he said.

Previously, at the appeal level, PT DKI Jakarta decided to uphold the South Jakarta District Court’s decision against the wife of the former Head of Propam Polri Ferdy Sambo, Putri Candrawathi, namely 20 years in prison, in the premeditated murder case of Brigadier N Yosua Hutabarat. Putri Candrawathi is now fighting back by filing an appeal against the decision.

“The PC filed an appeal for cassation on May 9, 2023,” said South Jakarta District Court Public Relations Officer Djuyamto in a written statement, Monday (22/5).

Not only Putri, Djuyamto said Ferdy Sambo and family driver Ferdy Sambo, Strong Ma’ruf, also filed an appeal. Petitions for cassation were filed by their respective legal advisers.

“The legal effort in the premeditated murder case of the late Yosua Hutabarat, that FS has submitted an appeal for cassation on May 12, 2023,” said Djuyamto.

“KM filed an appeal for cassation on May 15, 2023,” he added.

The Kapuspenkum Attorney General’s Office, Ketut Sumedana, admitted that he was new to the application for cassation. “I just heard from media friends,” Ketut told reporters at the AGO, Kebayoran Baru, South Jakarta, Monday (22/5/2023).

Ketut has no problem with the cassation petition filed by Sambo et al. He said that he would study the appeal.

“If he makes a cassation legal effort, we will see first, we will study it first, maybe we will also make an cassation legal effort, it’s usually like that,” he said.
