“Any fine imposed is unlawful” – The Daily Standard

Chairman of the security council Hubert Bruls, said just now that regional mouth masks may be introduced to prevent local outbreaks. However, according to professor of constitutional law Wim Voermans, fines or the like cannot be unlawful in an experimental, regional lockdown. Every fine that is handed out is unlawful, and municipalities shoot themselves in the foot.


Hubert Bruls told this after the joint consultation between Minister Van Ark, RIVM director Jaap van Dissel and the security regions. In the coming weeks, more research will be conducted into the experimentation and thus implementation of regional lockdowns. Which means: that you are wise to do extra mouth masks to stock up!

However, there is still disagreement about the mouth masks themselves. Mayors such as Halsema and Aboutaleb are happy to have a facemask obligation, but Van Dissel still insists: ‘there is no evidence’.

Nevertheless, despite the divisions within one’s own ranks, people are going to experiment with a mouth mask obligation. Because what will this look like in practice?

In the meantime, the most eminent professor of constitutional law in the Netherlands is also interfering in the discussion around regional mask. Because this is apparently not allowed and not allowed at all. It is illegal, even with the applicable emergency regulations it remains illegal.


This is going to be an interesting discussion when Voermans is actively involved in this again!
