Áñez’s lawyer: TCP ruling does not allude or mention the former president | ANF

The lawyer recalled that the TCP has already manifested itself previously through jurisprudence and clear and unequivocal acts “of recognition to the presidency of Jeanine Áñez, at the level of binding jurisprudence.”

La Paz, October 18 (ANF) .- Alain de Canedo, lawyer for former president Jeanine Áñez, clarified this Monday that constitutional ruling 0052/2021 at no point alludes or mentions the ex-president or links her to an alleged coup.

De Canedo indicated that this version is only from people and authorities related to the Government of the Movement for Socialism (MAS).

“Constitutional ruling 0052/2021 of September 29, at no point alludes or mentions the name of Jeanine Áñez, less does it refer to terms or words such as a coup d’etat or self-proclamation to the Presidency as several people and authorities have pointed out in recent days in different media, “said the lawyer at a press conference.

After the constitutional ruling was known, the Minister of Justice, Iván Lima, affirmed that the Plurinational Constitutional Court through its ruling 0052/2021 “has ratified that there was a coup in the country”, consequently, the Government calls to close the debate.

De Canedo clarified that the constitutional ruling deals with a specific issue in the Chamber of Deputies that are alleged acts and deeds committed by former deputies Susana Rivero and Simón Choque, in November 2019, which would presumably be unconstitutional.

“This issue was presented through an appeal for annulment by a former deputy named Margarita Fernández, in addition to that the sentence is quite confusing, which also leads to it being contradictory.” This sentence only has effect for the plaintiff ex-deputy, said De Canedo.

The lawyer recalled that the TCP has already manifested itself previously through jurisprudence and clear and unequivocal acts “of recognition to the presidency of Jeanine Áñez, at the level of binding jurisprudence.”

He added that there is also constitutional declaration number 001/2020 dated January 15 that expressly recognizes the presidency of Jeanine Áñez “by accepting the extension of her mandate, as well as legislators and other sub-national authorities.”

In addition, the Plurinational Constitutional Court recognized the accreditation of Jeanine Áñez as constitutional president of the State, in an appeal for prior constitutionality control of the Human Rights Compliance bill, after the political crisis resulting from the general elections.
