An appeal filed in Dijon against the obligation to wear a mask outside

The Victimes coronavirus France collective, which brings together people who have been infected by the virus, and C19, a collective of health professionals, have been opposing for several weeks the obligation to wear a mask outdoors, which has entered into force in several cities of France, like Dijon. Fabrice Di Vizio, the Ile-de-France lawyer for these collectives, decided to attack “all the prefectural decrees” imposing this rule, pointing to “inconsistencies”. Appeals have already been filed in Paris, Lyon, Nice, Montpellier and even Lille. And this Friday afternoon, the lawyer did the same with the administrative court of Dijon. The hearing should be held within a few days.

Me Di Vizio points to the absurdities of such orders. “While the Ministry of Labor authorizes the mask to be removed under certain conditions, while there is no consensus on the masks outside, how to justify these prefectural decrees which impose the mask outside, city after town? He said a few days ago. According to him, it is “the disproportion of the measure compared to the real situation” that poses a problem. By attacking these decrees, he wants the prefects to review their copies and “that they justify the generalization of the mask outside”.

And for now, the collectives have obtained satisfaction in Strasbourg and this Friday in the Rhône. The administrative court suspended the order of the prefect of the Rhône concerning the obligation to wear a mask in Lyon and Villeurbanne, in force since September 1. The prefect was asked to modify the decree by Tuesday, at noon, otherwise the suspension will be final.
