The case revolves around a paragraph in the Amsterdam Housing Regulation. It states that Amsterdammers do not need to apply for a permit to rent out their home if they meet a number of conditions – such as a reporting obligation.

But this possibility is contrary to the Housing Act, says the Council of State. The municipality is not authorized at all to grant exemption from the statutory permit requirement. Nobody can use that option anymore.
Amsterdam may continue to impose fines on residents who rent out their homes to tourists without a permit, but must therefore include additional rules in the municipal housing regulation.
