AirBnb Implements Stricter Compliance with New York City Vacation Rental Law

AirBnb will prevent the rental of apartments that do not comply with the vacation rental law.

New episode in the war between the city of New York and AirBnb since 2010! The town hall had adopted a new law in January 2022 which required owners to register on a short-term rental file. A law further strengthened in January 2023. Starting September 5, 2023, AirBnb will modify listings that have not obtained a New York City Hall registration number so that reservations only accept long-term stays of 30 nights or more. Given the criteria put in place by New York City Hall to obtain a “Class B” classification, there should not be many ads left… if anything at all! Reservations until December 1, 2023 will not be canceled . Be careful, however, that the owner does not cancel on his side at the last moment because this arrangement of AirBnb is not in accordance with the law. The New York City Hall insists on the fact that the law is effective from September 5, 2023 and not from December 1, 2023. To cover itself, AirBnb also specifies for the attention of the owners: “We will accept all cancellations of stays scheduled to arrive from September 5th requested by hosts, without penalties or impact on Superhost status”. An owner who fears pressure from New York City Hall will therefore be able to cancel at the last moment, leaving his customers with their beaks in the water. I recommend that you exercise the greatest caution if you have a rental that no longer meets the criteria of New York City Hall. The objective of the town hall is indeed to hit hard!Reservations for short stays whose arrival date is scheduled from December 2, 2023 will be canceled and refunded in full.Also be aware that New York City Hall rules apply to AirBnb and all other sites and agencies. These are therefore the same rules for everyone, regardless of the booking site.

What solutions to rent an apartment in New York

From September 5, 2023, the only solution for renting an apartment in New York will be to spend a minimum of 30 nights there. This radically changes the game! The other solution, for a short stay, is to book an apartment in an aparthotel or in a hotel. The supply of aparthotels or rooms with kitchenettes has also developed well in recent years in New York, particularly in Manhattan.
