Staff representatives want independent expertise from a facility department.
On Monday, the judicial court of Agen rendered its decision concerning a dispute between the members of the committee for hygiene, safety and health at work (CHSCT) and the management of the hospital center. Last September, the former appointed an expertise firm to analyze the functioning of the “HR” service (human resources) following a significant number of departures during 2020. The management of CHAN did not want to hear about it and said seized the court in summary to cancel this deliberation and another on the same subject but earlier.
The judicial tribunal rejects the management of its request by supporting this refusal with arguments. “It is established that a significant number of agents formulated complaints in the work unit concerned, that some of them expressed a real state of suffering, that the number of spontaneous consultations with the occupational physician could an increased time, which was the occasion to observe manifestations of moral distress, anxiety and loss of professional bearings. “
The hospital center can appeal the decision. The establishment’s CHSCT therefore has the possibility of ordering an inventory of the service.
