Administrative Court Rejects Lawsuit for Construction of At-Tabayyun Mosque in Meruya

State Administrative High Court (PTUN) rejected a number of residents’ claims related to development Masjid At-Tabayyun in the Taman Villa complex Meruya, West Jakarta.

In its decision, the panel of judges accepted the defendant’s exception, in this case the Governor of DKI Jakarta Anies Baswedan, by stating that the object of the dispute is not the authority of the Jakarta Administrative Court, because it is still the realm of civil law.

“Trial, exception, accept the defendant’s exception regarding the object of the dispute, not including a state administrative decision because it is a civil law act,” reads the verdict as quoted from the official website of the Administrative Court, Monday (30/8).

The decision was issued by the Panel of Judges, chaired by Andi Muhammad Ali Rahman, and two member judges, respectively Danan Priambada and Indah Mayasari, dated August 30, 2021.

The lawsuit for the construction of the at-Tabayyun mosque in Taman Villa Meruya, was previously filed by 12 local residents, and was registered with case number 76/G/2021/PTUN.JKT. The lawsuit has been filed since March 30 last.

Meanwhile, sitting as the only defendant, namely the Governor of DKI Jakarta, Anies Baswedan.

In the petition, they asked the panel of judges to cancel the Decree of the Governor of the Special Capital Region of Jakarta Number 1021 of 2020 concerning Approval for the Utilization of Regional Property in the Form of Land Located in Villa Meruya Park, South Meruya Village, Kembangan District, West Jakarta Administrative City to the At Mosque Construction Committee. Tabayyun Taman Villa Meruya.

“Requires the Defendant to revoke the Decree of the Governor of the Special Capital Region of Jakarta Number 1021 of 2020 concerning Approval for the Utilization of Regional Property in the Form of Land Located in Villa Meruya Park, South Meruya Village, Kembangan District, West Jakarta Administrative City to the At Tabayyun Taman Villa Construction Committee Meruya,” reads the petition.

With this decision, the process of building the at-Tabayyun mosque in that location will continue. Residents previously asked Anies to respect the legal process in the protest against the construction of the mosque.

The residents’ refusal regarding the construction of the mosque was conveyed when Anies carried out the process of laying the first stone as a sign of the construction of the mosque.
