Adam Bodnar versus TVP. The appeal court dismissed TVP’s appeal and ended the case regarding the words after Paweł Adamowicz’s death

The Warsaw Court of Appeal rejected on Tuesday the TVP lawsuit against Adam Bodnar for his statement on the circumstances of the death of Gdańsk President Paweł Adamowicz. By dismissing TVP’s appeal from the lower court verdict, he upheld the decision that Bodnar did not have to apologize and pay PLN 25,000 to the Great Orchestra of Christmas Charity. The Ombudsman reported on a final judgment in social media.

Ombudsman Adam Bodnar was sued in January last year by TVP. It was about his words spoken in the “Onet Opinions” program after the January attack on Paweł Adamowicz, as a result of which the president of Gdańsk died. They concerned the circumstances of the event.

What did Bodnar say?

The Ombudsman was asked on January 16, 2019, “could the way public television talked about Paweł Adamowicz in recent months have had an impact on what happened?” and “was that hate speech?”

– This can be considered as hate speech against a particular politician. What’s more, we have to pay attention – he feels competent in this, which media Mr Stefan could potentially have access to (W. – ed.). If he was locked up (in prison – ed.), He used the media on terrestrial television (…). So there is no access to the internet, there is no access to coded television (…) An information channel that is broadcast around the clock, that is TVP Info. There are other televisions, of course, but it is half an hour a day – said RPO.

– Are you suggesting that he was in jail and wound up because he turned on TVP Info in his cell? asked Onet journalist. – I don’t know if it was because it would have to be analyzed. But in my opinion this is one of those issues that should be clarified in this matter. What might the consequences be because of the lack of access to pluralism of views and whether this could also have an impact on behavior. I do not simply exclude such a thesis – the spokesman replied.

The appellate court finally closed the case

In January 2019, Bodnar was sued as a private individual by TVP for his statement. Television demanded an apology on the Onet portal, payment of PLN 25,000 for the Great Orchestra of Christmas Charity and reimbursement of court costs.

On May 24 last year, the District Court in Warsaw dismissed the claim. As the RPO reported on its website at the time, the court “held that Adam Bodnar’s statements had not violated the personal rights of the plaintiff.” The Ombudsman also noted that the complaint concerned him “as a private individual, although Onet.pl had invited the incumbent Ombudsman for an interview.”

However, TVP appealed against this decision of the court of first instance.

On Tuesday, the Ombudsman informed in social media that “The Court of Appeal in Warsaw dismissed TVP SA’s appeal and legally closed the case.” “Thank you all for your support,” he wrote on Twitter.

Death of Paweł Adamowicz
