The former mayor and head of the municipality of Hohenzell can breathe a sigh of relief. The two were acquitted of the allegation of abuse of office last week in the regional court in Ried. These acquittals are now final. The duo have been accused of not imposing unlocking and maintenance fees between 2001 and 2015. As a result, the municipality and the state of Upper Austria suffered financial damage of more than 80,000 euros. The OÖN reported.
“More than four years have passed since the complaint in 2016. This very long time was a very heavy burden for my client, which makes him all the more relieved that the acquittal is now final. It was the best news for him in a long time” , says the Rieder lawyer Peter Vogl, who represented the former local chief in court.
Vogl is not surprised at the acquittal. “From my point of view, it was clearly evident in the annual accounts for years that the municipal office had not collected any contributions. After all, they waited for a new zoning plan. Basically, the auditors of Upper Austria, which had filed the complaint, could have noticed earlier.
