-30% reduction in supplier discounts to supermarkets

-Prohibition of offers on products that have been repriced in the last quarter

-Cap of 7% on the gross profit of baby milk

For baby milk products, the Ministry of Development estimates that the initial prices decreased by an average of about 15%.

The question is whether it will really benefit the consumer, who from today will see a reduction in the nominal price of the products, but there is a risk that the discounts and offers will be drastically limited, with the result that the difference in practice will be minimal.

“Brake” on accuracy and misleading offers

Prevention of unjustified markups

  • 3-month ban on promotions on products that have been repriced since 10/1
  • Applies to all products, except: fresh products (fruits, vegetables, meats, fish)

Where discounts and promotions are prohibited

Specifically, according to the decision of the Ministry of Development for the implementation of measures to deal with price increases and for the specialization of promotional actions and discounts, from January 10, 2024, for consumer products for which a price increase is announced, no promotional action is allowed during available to consumers for three months from the date on which the price increase is applied.
In detail, the following promotions are not allowed:

a) The sale of a product for which it is declared in any way that it is sold at a lower price than any reference price (e.g. discount or offer),

b) the sale of a product for which it is declared in any way that it is sold in a package containing an additional quantity as a “gift” for the consumer,

c) the sale of multiple packaging, consisting of more than one identical packaged product, for which it is declared in any way that it contains one or more “GIFT” packaging or that it is offered at a lower price than any reference price (e.g. a discount or special offer),

d) the sale of a product that is declared to be sold together with another, different, product as a “GIFT”,

e) the sale of a product with a discount or offer provided by a discount coupon, gift certificate, shopping points or other reward systems (e.g. loyalty cards),

f) participating in any brochure or retailer advertisement that states or implies that the product is offered at a price advantageous to the consumer (eg references such as “only”, “best value”, “excellent price”, “bargain”).

The above also applies to products that are introduced to the market for the first time, with the same or a different name, with the same or a different package, and a different barcode:

a) After the withdrawal of another product of the same company with the same or similar properties or

b) contain a smaller or larger quantity, by 50%, than another similar or similar product available on the market by the same company, with an increased unit price, or

c) are made available by another new company that collaborates or is connected with a company that already offers consumers products of the same category from the entry into force of this.
