The move that Margherita could now risk, as noted by the Courier service, is that of the challenge of the mother’s succession: “If she maintained that the applicable law is the Italian one and not the Swiss one, she would claim the right to the legitimate, that is 50% of the hereditary axis of the mother”. The path is uphill, since Marella’s succession opened in Switzerland, where the “succession agreements” are valid, such as the one that Margherita signed in 2004, renouncing to inherit her mother’s shares in the future. But that pact could not hold up if Marella were considered Italian for successor purposes, according to the theses of Margherita’s lawyers.
