Tensions in the Agnelli family do not subside. Margherita, daughter of Gianni Agnelli and Marella Caracciolo, would be trying to put in place a meticulous legal maneuver to put the inheritance of the parents into play. At the center of the dispute is the safe of the group, the company “December”. It is – as the Corriere della Sera – of an kingdom of 30 billion euros which has numerous companies listed on the stock exchange, starting with Stellantis. Kingdom at the head of which is the first of Margaret’s eight children, John Philip Elkann, 45 years.
Legal sources close to the Elkann family, however, let it be known that “these rash claims, which will be firmly resisted in every location, however, they are not suitable to question the absolute majority stake that John Elkann holds in the December company. “In other words, they made her understand that there is no need to go back to past issues, after she signed a definitive agreement in 2004 in Geneva with grandmother Marella giving up the quota in December and grossing over a billion, and especially after he wanted to question it years later, losing up to the Supreme Court.
On the other hand, however, the lawyers of Margherita, 65, question the formal correctness of the documents underlying the current structure of the “December”, of which John holds 60%, while Lapo and Ginevra each have 20%. The move that Margherita could now risk, as noted by the Courier service, is that of the challenge of the mother’s succession: “If she maintained that the applicable law is the Italian one and not the Swiss one, she would claim the right to the legitimate, that is 50% of the hereditary axis of the mother”. The path is uphill, since Marella’s succession opened in Switzerland, where the “succession agreements” are valid, such as the one that Margherita signed in 2004, renouncing to inherit her mother’s shares in the future. But that pact could not hold up if Marella were considered Italian for successor purposes, according to the theses of Margherita’s lawyers.
