A complaint is directed to the Constitutional Court, which more than 60 senators want to annul the measures introduced by the government of Prime Minister Andrej Babiš.

In particular, due to the increase in the number of coronavirus infections, some stores in the Czech Republic had to be closed. On the other hand, others have an exception. And according to senators, this is discrimination.

The constitutional complaint arose in about three days and was written by Senator Lukáš Wagenknecht (Pirates). The complaint will be filed in the near future, the authors are only fine-tuning the last details.

“It was signed by 63 of the 81 senators,” Wagenknecht told the Report List. According to him, this is probably the largest number of senators who have ever supported a constitutional complaint since the establishment of the Senate.

Seven lawyers or law specialists worked on its preparation. One of them is lawyer Eduard Belšán.

According to him, the complaint states, among other things, that it is not clear why shoe, clothing, furniture or electrical stores must be closed, offering washing machines and refrigerators or computers, which are needed for online work from home or teaching during government restrictions. children. But florists or hardware stores are open.

“There are innumerable such irregularities when it is not possible to use a concept other than unjustified discrimination across the groups of persons concerned for such a situation. Nowhere has the government explained why it has adopted a ban for some establishments and why other establishments have an exception to the ban, “said Belšán.

In addition, Wagenknecht said that the impetus for filing a constitutional complaint was also a few days old measure, which limits the capacity of one customer in the store to fifteen square meters.

However, the introduction of this measure did not reopen these smaller establishments. According to Wagenknecht, they could easily regulate the number of people in the store.

With a constitutional complaint, the senators want the measure to be repealed. That is, for the stores to reopen.

“The proposal is such that it should be repealed. But the goal is to create a level playing field and end the discrimination that has arisen here, “said Belšán. “The Constitutional Court is the one that can intervene and shed light on it,” he added.

In the complaint, they also argue – as mentioned – that the measures are not sufficiently explained. Which was the main reason why last week the Municipal Court in Prague annulled a measure ordering the wearing of veils in public or in public transport.

The court annulled this measure – as explained by Judge Aleš Sabol – because the reasoning lacked why certain groups did not have to wear veils. Exceptions in this context were given to children under two years of age, kindergarten teachers, athletes, judges or moderators.

In this case, moreover, the problem was that the Ministry of Health only gradually copied the earlier justification into the measures from 19 August.

At the same time, according to the extraordinary regulation from August, it was necessary to wear veils only in some buildings and public transport or trains. Over time – as the number of coronavirus infections increased – then it tightened.
