Madrid’s Supreme Court (TSJM) has dismissed a government blockade on the Spanish capital and nine surrounding municipalities – the regions with the highest COVID-19 rates in the country. The court found that the restrictions infringe fundamental rights. The Spanish prime minister did not rule out the restoration of the emergency in Madrid.

The ban on leaving the city without the appropriate documents, restaurants open until 10 pm and at most half of the hotel beds are occupied – these are some of the restrictions introduced on October 2 in the metropolis of Madrid, which has almost 5 million. On the same day, the city administration appealed them to the Supreme Court. She argued that due to the restrictions, the city would lose EUR 750 million a week, and the entire state – EUR 2 billion.
The Madrid court has complied with the demands of the Madrid authorities. He considered that their introduction was against Spanish legislation. In the published justification, signed by six judges of the Supreme Court, it was stated that the bans in force interfered with the lives of the city’s inhabitants. “Their introduction does not justify the restriction of fundamental rights,” reads a document from a Madrid court.
The government has the right to appeal against the decision of the TSJM twice. First, to the judges who signed the verdict, and then he can apply for a cassation of the judgment. After the ruling was announced, Prime Minister Pedro Sanchez, on an official visit to Algeria, did not rule out restoring the state of emergency in the Spanish capital, the first level of the state of emergency. It was in force in Spain from March to the end of June. Madrid is the place most affected by the pandemic. In the entire metropolis, COVID-19 was found in 255,615 people, of whom 9,634 died (591.6 patients per 100,000 inhabitants). In Spain, the coronavirus has affected almost 836,000 people, 32,562 died.
