The Council of State validates the processing of sensitive data in information files
The January 4, 2021, the Council of State rejected appeals for annulment against decrees authorizing the processing of sensitive data in the context of information files, on the grounds that only data from “activities likely to endanger public safety or the security of the State“are processed and that the selection in the processing of a particular category of persons is prohibited. Therefore, this collection did not lead to”serious and manifestly unlawful interference with the right to respect for private life or freedom of opinion“.
