[사회][속보] Victims of’Samrye Case’ win a lawsuit for damages against the state

A court ruling that the state and the then investigative prosecutors should compensate the victims of the’Samrye Nara Super Case’ who were accused of murder 22 years ago and were imprisoned unfairly.

The Seoul Central District Court ruled that some of the plaintiffs won a lawsuit for damages filed by three victims, including Choi Mo, their families, and bereaved families today.

Three people, including Choi Mo, who had been imprisoned in the past three cases, were recognized as compensation for 300 to 400 million won each, and 10 to 100 million won to the victims of robberies, their families, and survivors.

Among them, the court admitted that Moo Choi, who was an investigative prosecutor at the time, was also responsible for paying part of the compensation, and dismissed the counter-action lawsuit Choi filed for defamation.

The Samrye case was a robbery murder in Samrye-eup, Wanju-gun, Jeollabuk-do in February 1999. At that time, the so-called “Three-member Samrye”, including Mr. Choi Mo, who had an intellectual disability, were convicted and sentenced to 3 to 6 years in prison in the Supreme Court.

However, when Jinbeom, who was innocent after being investigated by the prosecution at the time, declared conscience in 2015, the three members of the Samrye were found acquitted after a retrial, and subsequently filed a lawsuit against the state and lawyer Choi, asking them to compensate for the damage they suffered from unfair jail.

The following year, the Supreme Prosecutor’s Office’s historical fact-finding team re-examined the case, but it was concluded that it was difficult to hold the prosecutor directly responsible at the time, and the real criminals were not punished after the statute of limitations.
