▷ Lawsuits against diesel scandal recalls: Daimler wants to unsettle consumers

As part of the diesel scandal, the German car manufacturer Daimler will take legal action against the official recalls of a total of 1.4 million Mercedes-Benz vehicles. “In the USA, Daimler has already raised billions to compensate the authorities and around 250,000 defrauded US customers for the emissions scandal. In this country, the company still vehemently denies the allegations of manipulation. But even German Mercedes-Benz owners have to deal with the consequences of the Fight vehicle tampering.

Since the scandal became known, the demand for diesel vehicles has plummeted. In particular, vehicles that have been demonstrably manipulated have suffered an enormous decline in value, as they are fundamentally exposed to a constant risk of decommissioning and the medium-term consequences of software updates for consumers cannot be foreseen.

Affected vehicle owners therefore have the opportunity to defend themselves against this fraud and to assert claims for damages. But as long as Daimler keeps a low profile on the matter and continues to refer to proven manipulation as permissible, this will certainly irritate some consumers.

In the worst case, these vehicle owners could be left with their damage, because in the case of fraud and immoral acts, a limitation period of three years from the knowledge of the injured party applies. Since the first recalls in the Daimler diesel scandal occurred in 2018, the rights of some of the owners concerned could expire on January 1, 2022.

At the same time, it can be assumed that the following recall court proceedings will end in summer 2022 at the earliest. Daimler hardly has any chance of success in court. But the proceedings once again give Daimler the opportunity to prevent as many vehicle owners as possible from asserting their legal claims. These are the rights in the emissions scandal

Affected Mercedes owners have the option of returning their manipulated vehicle to the responsible manufacturer. In return, there is a financial compensation, which is composed of the original purchase price of the vehicle minus a compensation for use. The latter depends on the individual mileage of the respective vehicle. In addition, the claimants concerned will receive interest on arrears from the day the claim is filed, which increases the amount of compensation.

Alternatively, there is also the option of continuing to use the manipulated vehicle and claiming part of the purchase price as compensation. In this case, around 20 percent of the original purchase price can be enforced in the form of compensation.
