Tencent Disputes sony’s Claims in ‘Light of Motiram‘ Trademark Lawsuit, Argues “Fame Does Not Make a Trademark”
SAN FRANCISCO, CA – Tencent has fired back at Sony Interactive Entertainment in the ongoing legal battle over alleged similarities between its upcoming mobile game, Light of Motiram, and Sony’s Horizon series.The dispute centers on claims that Light of Motiram‘s protagonist closely resembles Aloy, the iconic hero of Horizon Zero Dawn and Horizon Forbidden West.
Sony filed a lawsuit in February 2024, alleging trademark infringement and unfair competition, seeking to halt the release of Light of Motiram. Tencent is now arguing the case is premature, as the game isn’t scheduled to launch until late 2027, and that Sony is suing the wrong entity – Tencent Holdings, rather than the game’s developers, Tencent Shanghai and proximity Beta.
A key point of contention is Sony’s reliance on Aloy’s popularity as a basis for trademark protection. Tencent’s legal team countered this argument directly, stating, “fame does not make a trademark.” They assert that Sony has failed to demonstrate a legally protectable trademark beyond the character’s general appearance, noting that “generalized descriptions are not enough to identify a trademark.” Sony’s complaint, according to Tencent, characterizes the trademark based on “attire, accessories, and facial markings,” which are insufficient for legal recognition.
The Chinese firm is seeking a full dismissal of the case, while Sony aims to prevent the release of Light of Motiram. Should the courts side with Sony, a protracted legal battle is anticipated, though a settlement remains a possibility. A ruling on whether the case will proceed is expected in the near future.
