McSkimming, 54, resigned from his position as Deputy Commissioner in May 2023 amidst separate investigations by the Autonomous Police Conduct Authority (IPCA) and New Zealand Police. he was arrested in late July and his identity was publicly revealed on Monday, October 30, 2023, following the lapse of an interim name suppression order. He is currently on bail and scheduled to appear in court again in November.

Andrew coster, who served as Police Commissioner until April 2023, addressed the case during a Thursday interview on Nine to Noon, stating he was unable to provide further comment due to the ongoing legal proceedings. Current Police Commissioner Richard Chambers has affirmed that the prosecution demonstrates accountability within the police force.
The IPCA is conducting two separate investigations. The first prioritizes allegations of misconduct stemming from a public complaint. The second examination focuses on potential misconduct or neglect of duty by any other police officers or employees related to the handling of the allegations against McSkimming. No completion timeframe has been provided for either IPCA investigation.
