Reciprocal Tariff Adjustments: Agricultural Products Exempted – The White House

Presidential Order Regarding‌ Tariff Adjustments

Executive order

WHEREAS, a national emergency was ‍previously⁢ declared ‍under Executive Order 14257, as amended; and

WHEREAS, it has been determined that certain ‌agricultural products shoudl be exempt from the reciprocal tariffs established under⁣ Executive Order 14257, as amended;

NOW, THEREFORE, I, Donald J. Trump, President of the United States, by the authority vested in me by the Constitution and the laws of the United States, hereby order the following:

Sec. 1. Agricultural Exemptions. ​Updated versions of annex ‍II to Executive Order 14257, as amended, and‌ the Annex to Executive Order 14346, entitled “Potential Tariff ​Adjustments for Aligned Partners,” are hereby adopted ⁣and shall take‍ effect with respect to goods entered for consumption, or withdrawn from ‌warehouse for consumption, at 12:01 a.m. eastern standard time‌ on⁢ November 13, 2025. These⁢ modifications are deemed necessary and appropriate to address the⁢ ongoing‌ national emergency declared in Executive order 14257.

sec.⁣ 2. Global Tariff Schedule ⁢Updates. The Harmonized Tariff schedule of the United States shall be modified ‍as detailed in⁢ Annex I to this order. These modifications will be effective for goods ‍entered for consumption, or⁣ withdrawn from warehouse for consumption, on or after ⁤12:01 a.m.⁢ eastern ⁢standard time on November 13, 2025. Any duties collected as an inevitable result of these modifications that require refunding will be processed in‍ accordance with applicable law and the standard ‌procedures of U.S. Customs and Border Protection.

Sec.3.Implementation and‌ Monitoring.

(a) The Secretary of⁢ Commerce and ⁣the United ⁤States Trade Representative shall ‌continuously monitor the circumstances related to the emergency declared in Executive Order 14257 and regularly consult‍ with any senior officials they deem appropriate. They shall promptly inform me of any developments that‌ may necessitate further Presidential action.

(b) The ⁢Secretary of Commerce, the Secretary of Homeland Security, and the United States Trade Representative are directed and authorized, consistent with applicable law, to take⁣ all necessary ⁣actions to​ implement and effectuate⁢ this order.⁣ This includes adopting rules,regulations,and guidance,and ⁣utilizing all ‌powers granted to‍ the President,including ‌those under the International Emergency Economic Powers‍ Act (IEEPA). These officials may redelegate functions within their respective departments or agencies as appropriate. all executive departments and agencies shall take all measures within their authority to implement this⁢ order.

Sec. 4. Severability. should any provision of this⁤ order, or its application⁢ to any specific individual​ or circumstance, be deemed invalid, the remaining provisions and their application to other individuals or circumstances shall remain in full force and effect.

Sec. 5. General Provisions.

(a) ‍Nothing in this order shall ⁣be construed to diminish or otherwise affect:

(i) The authority granted by law to any executive​ department or agency, or its head; or

(ii) The functions of​ the Director of the ‍Office of Management⁤ and Budget concerning budgetary, administrative, or legislative matters.

(b) Implementation‍ of this order is subject to⁤ the‍ availability of appropriations and consistent ⁤with all applicable⁤ laws.

(c) This order does not create any right or benefit, whether substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, entities, officers, ⁢employees, or agents, or ⁣any⁢ other person.

(d) The United states Trade ⁢Representative shall bear the costs associated with the publication of this order.
