Man jailed for punching driver and smashing her partner’s car gets apology from cops

Man’s Assault Claim Sparks Scrutiny Amid Ongoing Court Case

A recent court case involving an alleged road rage incident has brought to light claims of police misconduct and a separate, brutal assault. The situation has left one man seeking justice and raising serious questions about how law enforcement handled his complaint.

The Initial Incident

Last week, Paul Dunstan appeared in court to appeal his conviction and seven-month jail sentence related to a shocking incident. He maintains his actions were wrong, but asserts he should not have been the only one in court.

The incident, as shown in court footage, involved Dunstan repeatedly ramming Stephen Elliott’s car with his van. The footage then shows an altercation between Dunstan and Tammy Sparkes, a neighbor, resulting in punches thrown by Dunstan.

“I was assaulted repeatedly while I was unconscious but the police chose to focus on what I did wrong that night and only showed the judge a section of the video that showed me doing wrong.”

The Unaddressed Assault

The most shocking part of the video evidence, according to Dunstan, is the footage of an unidentified man kicking him in the head while he lay unconscious. The police were asked about their investigation and why they didn’t act, but declined to comment.

Dunstan says that a senior police officer contacted him to apologize for the failure to follow up on his complaint. He says he was interviewed by police, who allegedly acknowledged he was a victim of serious assault, but says nothing further happened. According to the Bureau of Justice Statistics, approximately 22% of physical assault cases are closed without an arrest (Bureau of Justice Statistics).

Further Details of the Incident

Dunstan says he was charged and convicted of assault instead, and has vowed to clear his name. He believes the police are discriminating against him. He said the authorities only showed the judge a blurry and edited version of the video evidence.

Paul Dunstan started repeatedly rammed Stephen Elliott’s Peugeot 208 car.

Tammy Sparkes was also involved in the incident and had been involved in a series of road rage attacks. She was the next door neighbor to Dunstan at the time of the event.

“Look, I know what I did was very wrong, I shouldn’t have rammed the car like that but I was under major stress at the time because both my parents had been in and out of hospital and I needed the van for work and to go to hospital.”

The situation is ongoing, with Dunstan now stating that he will take his case to the Police Ombudsman.
