Working time shortened to 35 hours a week, and holidays extended from 20 days and 26 days to 35 days – and for everyone. There were recently announcements about two great reforms in the Labor Code. Revolutions canceled, longer holidays should be forgotten. And a shorter work week?

Working time will probably be shortened, although certainly in this matter the revolution must be canceled. For now, the pilot -financed pilot will be chosen shorter as part of the pilot financed by the Ministry. Will the companies choose the variant – all weekends are three days, days shortened to 7 hours or some other solution – it will only turn out.
One thing is certain-a four-day work week is now a dream of not a category at all than a longer 35-day vacation, allowing employees to rest without choosing: 14 days in summer, and 14 days in winter. NAWE, if the provisions of the Labor Code changed in terms of URLPs do not go so far that, following the example of the current warranty for one, uninterrupted 14-day vacation, guarantee all employed two such uninterrupted 14-day, in the overall pool of 35. Days of holiday leave in the year.

Holiday leave 35 days: longer holiday leave without a revolution in the Labor Code

Longer holiday leave – 35 days a year instead of 20 or 26 as it is now, is a postulate of trade unions, reported to the Ministry of Family, Labor and Social Policy.
The argument is simple and obvious. The Labor Code was adopted and implemented over half a century ago, in completely different economic realities. Employee leaves regulated in this way have not changed at that time. However, circumstances and realities have changed. Poles work harder than ever and in this respect have become a dominant nation in the world. Conditions in companies have also changed – now it is easier than ever to model working time.

The so-called work-life balance also brings new challenges, i.e. looking for a balance between a professional career and private life, especially family life.
It is unfair that some employees have 20 days of vacation and others 26 days – for work in the same conditions.

This issue has been discussed for a long time, regardless of the postulate of general changes in the field of vacation in labor law.
Would it be fair to extend the holiday leave to 35 days a year? Since there is general consent that working time should be changed, longer holidays are one of the variants of shortening working time.

Certainly at the same time less organizationally troublesome – and therefore costly for companies – than shortening the working week.
The benefits are obvious. Currently, the Labor Code, guaranteeing a specific dimension of vacation leave, gives one more guarantee – the use of at least 14 days in a row continuously, because only such a vacation dimension guarantees reliable rest.

Employees taking holiday leaves have a dilemma – whether to use these 14 days in summer or winter.
In the case of families with children, this is important because it is closely related to breaks in school in schools – holidays and winter holidays.
If the holidays were extended by the next days-preferably 9 days a year, then each employee could go twice for such a longer rest.

Holiday leave 35 days: longer vacation after changes in the Labor Code: who will use

Additional holidays as a non -wage employee benefit: how many days of additional leave, who is entitled, on what terms.
The subject of the revolution in the Labor Code consisting in the statutory extension of vacation leaves from 20 and 26 days to 35 days, has collapsed – at least for now.

The only specific benefit for employees is associated with another revolution that is already implemented – a change in the rules of determining the seniority. Because it will be included in it – and with the power back – periods of work on orders, economic and similar activities, with the entry of these changed principles into force, many people who now have the right to 20 days of vacation instead of 26, due to the shorter internship, will automatically gain 6 days of vacation a year.

It is worth noting, however, that more and more companies offer holidays to their employees – all or selected groups of employed – extended over the time of time provided for in the Labor Code within the so -called benefits and thus non -wage benefits.
This is enabled by changes in the labor market, in particular the implementation and regulation of remote work rules in labor law.

The experience of these companies may be the basis for analyzes needed, but to conduct a revolution in the field of vacation in the Labor Code.
As at the currently announced shortening of working time, pilot is to be conducted, co -financed by the labor department, showing how a four -day or shortened work week works in practice.
