How German Authorities Calculate Usufruct and Residence Capital Values

October 31, 2026 Priya Shah – Business Editor Business

German tax authorities are applying updated statutory valuation tables under sections 14 to 16 of the Valuation Act (BewG) to calculate the capital value of lifelong usufruct and residential rights for gift and inheritance tax purposes in 2026. According to reporting by h-kruse.de, the resulting fiscal value determines how much of an asset’s market value remains taxable after deducting the capitalized right and applicable personal allowances.

Law Establishes Caps for Calculating Annual Property Value

The capital value formula multiplies an annual value by a statutory multiplier derived from federal mortality tables. For residential rights, the annual value is typically the usual rent for the designated rooms over twelve months. For a usufruct arrangement on rented property, it equals the rental income minus costs borne by the usufructuary.

The law establishes a firm ceiling on this annual value. Under section 16 of the Valuation Act, the annual amount cannot exceed the tax value of the property divided by 18.6. For a property assessed at 600,000 euros, that cap stands at approximately 32,258 euros annually. If local market rents exceed this threshold, the tax office applies only the statutory maximum.

Multipliers Linked to Age and Gender

The Federal Ministry of Finance publishes the multiplier table annually, incorporating current mortality statistics from the Federal Statistical Office alongside a fixed statutory interest rate of 5.5 percent. Tables applicable to gifts and inheritances occurring from January 1, 2026, rely on the ministry’s circular issued on October 21, 2025.

Age and gender dictate the final factor. Because official statistics assign women a higher statistical life expectancy, female beneficiaries carry higher multipliers than males at the same age. For instance, a 60-year-old female carries a multiplier of 13.832, compared to 12.798 for a male of the same age. At 70 years old, the figures adjust to 11.107 for women and 9.938 for men. By age 80, the multipliers drop to 7.490 and 6.509 respectively.

Lower age brackets produce higher multipliers because the right is expected to run longer, which increases the total capital value deducted from the taxable estate. When a right covers multiple individuals, such as a married couple, specific joint valuation rules determine the applicable factor.

Tax Adjustments Following Early Termination

When a beneficiary dies significantly earlier than the average life expectancy assumed by the statutory table, tax authorities can retroactively adjust the assessment under section 14 paragraph 2 of the Valuation Act. The length of time the right must remain active to avoid a recalculation depends on the beneficiary’s age category at the time of the transfer. For individuals aged between 70 and 75, that minimum duration is five years, dropping to four years for those aged 75 to 80.

An early termination below these thresholds leads to a smaller tax deduction and a subsequent additional tax payment for the recipient. This retroactive adjustment applies solely to values derived from the official tables. If the parties established the value of the right through a specialized real estate or market valuation report rather than the standard formula, no subsequent tax adjustment takes place.

Distinguishing Tax Capital Values from Market Reality

The statutory capital value calculated for tax administration differs substantially from the economic market value. Section 14 paragraph 4 of the Valuation Act explicitly rules out substituting alternative interest rates or customized life expectancy estimates to alter the tax figure. Conversely, when resolving property sales, compulsory portions, marital asset balancing, or estate disputes, courts and transacting parties rely on the real market value defined under section 194 of the Federal Building Code.

Properties encumbered by a lifelong usufruct face significant market friction. Prospective buyers cannot occupy the premises or collect rental income for an unpredictable duration, and lending institutions typically demand that their mortgages hold first-rank priority ahead of any registered residential rights. These operational limitations mean actual market discounts often exceed the rigid figures generated by statutory valuation formulas.
