Cesar Chavez Abuse Allegations: UFW Faces Potential Legal & Financial Fallout

The United Farm Workers (UFW) faces potential legal action following allegations of sexual abuse against its late founder, Cesar Chavez, detailed in a New York Times investigation published Wednesday. The allegations, which include accusations of abuse against underage girls and fellow labor leader Dolores Huerta, have prompted the UFW to cancel planned celebrations honoring Chavez and are raising questions about the union’s potential liability.

Several legal experts suggest the UFW could be vulnerable to significant payouts due to recent changes in California law expanding the window for victims of older sex abuse cases to file lawsuits. John Manly, an attorney who previously secured settlements in high-profile cases against USA Gymnastics and a USC gynecologist, stated that “liability could be automatic” for the union, emphasizing the focus will be on determining “who knew what, and when.”

California legislation passed over the last five years has broadened the circumstances under which victims can sue over past sexual abuse. A law enacted this January created a two-year window for adult survivors to pursue cases, particularly those involving institutional cover-ups. AB 218, passed in 2019, allows victims of childhood sexual assault to sue within five years of discovering a psychological injury related to the abuse. These laws have already spurred thousands of lawsuits against institutions like the Catholic Church and public school districts, resulting in settlements totaling billions of dollars.

The New York Times investigation revealed allegations that Chavez engaged in sexually abusive behavior with two underage girls in the 1970s and with Huerta in the 1960s. The report also noted that some UFW leaders were aware of allegations of sexual misconduct by Chavez “for years.”

In a statement released Wednesday, the UFW described the allegations as “profoundly shocking” and announced the cancellation of Chavez Day events. The union pledged to prioritize support for those affected and encouraged community members experiencing distress to seek mental health services. The UFW did not immediately respond to inquiries regarding its potential legal exposure.

Brian Claypool, a lawyer representing California sex abuse victims, indicated the UFW could be held liable if it’s proven that members of the organization knew or should have known about Chavez’s alleged abuse of minors. He also called for a broader criminal investigation to determine if others were aware of the abuse and actively concealed it. “Child sexual abusers in positions of power like Chavez rarely act alone,” Claypool said.

Luis Carrillo, a sex abuse attorney who participated in the farm labor rights movement alongside Chavez, expressed shock at the allegations, stating that his “hero was forever tarnished.” Carrillo suggested the extent of the damage to the organization’s reputation will depend on whether evidence emerges demonstrating a deliberate cover-up of abuse reports. “Here’s truly a shock for not only the allegations, but how the victims were ignored,” he said. “I am sure someone has reported this before.”
