NSPCA dismayed over NPA declining to prosecute Julius Malema for cruelty

NSPCA Decries Decision to Not Prosecute Malema for Alleged Animal Cruelty

Disappointment voiced as NPA cites insufficient evidence

The National Council of SPCAs (NSPCA) has expressed significant disappointment following the National Prosecuting Authority’s (NPA) recent decision not to proceed with charges against EFF leader Julius Malema.

Allegations Stem from 2023 Video Incident

The case, initiated by the NSPCA in September 2023, revolves around a video that circulated widely, showing Mr. Malema attempting to slaughter a cow. The NSPCA contends that his method inflicted unnecessary suffering, violating the Animals Protection Act.

The animal welfare organization stated that it had provided crucial supplementary video evidence, affidavits, and a key eyewitness who captured further footage at the scene.

“Yet, in a letter to the NSPCA, the NPA stated ‘the prosecution will not be in a position to adduce sufficient evidence to prove beyond reasonable doubt’ that a contravention of the act occurred. The letter further cited the ‘authenticity’ of the video footage as a concern.”

The NSPCA indicated that the case had encountered numerous obstacles, prompting them to escalate their efforts.

“While we acknowledge and respect the independence of the prosecutorial process, we are disheartened by this outcome,” the NSPCA commented. They added, “We believed the available evidence merited judicial consideration. This decision will no doubt be dismaying to many South Africans who care deeply about the humane treatment of animals.”

The organization highlighted the broader struggle for animal protection within the justice system. “This matter also underscores a broader issue: the continued struggle for animals to achieve visibility and protection in the justice system. The law must be applied consistently,” stated the NSPCA.

In South Africa, animal cruelty convictions can carry sentences of up to three years imprisonment or a substantial fine, underscoring the seriousness with which such offenses are treated legally. According to the World Animal Protection, animal cruelty cases often highlight the need for stricter enforcement and public awareness campaigns.
