The high-stakes political contest has returned to the courts following disputes over candidate disqualifications and election procedures. According to Hawaii News Now, the Hawaiʻi Supreme Court scheduled oral arguments for August 25, 2026, to resolve the ongoing contention surrounding the seat.

The timeline is compressed. Trevor Ozawa pressed for an expedited calendar to guarantee a final decision before general election ballots are printed in mid-September 2026. Meanwhile, Tommy Waters indicated he is weighing a formal challenge to the election over his disqualification. If Waters remains off the ballot, Trevor Ozawa and Tara Malia Gregory will appear as the certified candidates.

Recusals and the Appointment of Neighbor Island Judges

The judicial review required unusual administrative adjustments after eight appeals court judges, including Chief Justice Vladimir Devens, recused themselves from the case. The recusals stemmed from potential conflicts of interest tied to personal or professional relationships with the litigants.

Attorney Lance Collins explained to Hawaii News Now that close personal or professional connections—such as past law partnerships—form standard grounds for judicial disqualification. To form a quorum, the court appointed neighbor island judges to sit alongside remaining Supreme Court members.
