We remind you that the PNL parliamentarians Daniel Fenechiu and Gabriel Andronache submitted, on September 18, to the Parliament, a legislative proposal that provides that the president of Romania can run, in the last 3 months of the mandate , as independent on party or alliance lists in the parliamentary elections. The project changes, in this sense, article 52 of the law on the election of the Senate and the Chamber of Deputies.

“The President of Romania, according to the date of the election of the Chamber of Deputies and the Senate, if he is in the last 3 months of his mandate, can run as an independent candidate on the lists of a political party, a political party . alliance or electoral alliance to obtain the mandate of senator or deputy. If a senator or vice-president is elected, the president of Romania is obliged, after confirmation, to choose between the quality of senator or vice-president and the quality of president”, said the draft.

After Marcel Ciolacu announced that the PSD would not vote on the change and the Legislative Council said that an independent candidate means “a natural person who runs with self-nomination and has a list of supporters attached to the application his”, and not someone he is not a part of – a party, PNL, decided to ask for clarification from BEC.

In address Sent to the BEC, the PNL said that the idea of ​​an independent candidate “is used by the legislator in relation to the ban established for the natural person who does not have the capacity to be a member of a party to be able to run on lists of that political party in the parliamentary elections”.

“We believe that the interpretation given by the Legislative Council in 2024 is erroneous and contradicts the opinion of the same Legislative Council from 2004 (opinion no. 1027/2004, attached) because it does not it shows the purpose of the rule that the main legislator intends”, it is reported in the address sent by the PNL to the BEC and signed by Lucian Bode.

“We repeat that the legislator believed that people who are completely natural should only be in the lists of candidates in accordance with the party for which they are running in the parliamentary elections , that there was a guarantee that the candidates of the political program would consider values. ​for which the party/federation runs in the parliamentary elections with the aim of obtaining the parliamentary majority, forming the Government and using legislative power and later executive power, for the political program which is presented at the parliamentary elections to implement”, said the PNL in the address to the BEC, consulted by HotNews.ro.

Ion Iliescu’s predecessor

PNL argued that there was no law. 208/2015, art. 52, para. 5 “establishes a complete ban on natural persons who do not belong to a political party running on that party’s lists in the elections for the Senate and the Chamber of Deputies”.

The text of the law referred to by the PNL: “Independent applications will not be admitted to the lists of candidates submitted by political parties, political alliances or electoral alliances. Lists of independent candidates will not be accepted either.”

PNL said that in 2004 the Legislative Council issued a favorable opinion for a similar bill, when the law was changed because of Ion Iliescu be able to run for a parliamentary seat.

“This opinion from the Legislative Council came to clarify the not so clear way in which the legislator had chosen to regulate the ban for independents, people not connected to a political party”, it is reported in the address signed by the general secretary of the PNL, Lucian Bode.

Another argument is that the draft law adopted by the Parliament for Ion Iliescu in 2004 went to the Constitutional Court of Romania (CCR), which was notified at that time.

“Regarding the above arguments, we ask you to issue a decision regarding the interpretation of the provisions of art. 52, paragraph (5) of Law 208/2015 regarding the election of the Senate and the Chamber of Deputies, as well as the organization and operation of the Permanent Electoral Authority regarding the concept of “independent candidate” that the standard text mentioned above there”, according to the PNL address.
